Contract Terms & Conditions

BOOKING
Photographer must confirm the date and time of a session or any changes about the session. The session will take place indoors/outdoors in Holbrook with or without snow or lights. In the event of inclement weather, all sessions will be indoors. Photographer reserves the right to reject special requests if necessary. Requests may be accepted although are not guaranteed in the final product.

PAYMENT
This purchase is non-refundable (unless photographer cancels without an alternate date and time). Payment will be kept to offset any loss of business. The cost of the session covers time and talent.

PROCESS
Session is valid for up to three individuals. Not valid for children under one year of age. Children under 18 must be supervised by a guardian at all times during the session. Photographer will provide props if applicable (or none if client desires) and client’s props may be used at the discretion of the photographer. Client is expected to treat all props with care and photographer is not responsible for damages to props over $100. An additional $25 is required for each additional 1/2 hour beyond the scheduled session. Extended sessions are based on the photographer’s availability and time of day. Outdoor sessions during the golden hour may or may not be extended based on lighting conditions and photographer’s judgment. Client is responsible for physical participation in the session and it expected to voice concerns with posing before the session or during the session. Julbaby Photography LLC is not responsible for physical injuries that might occur during the session. Julbaby Photography LLC is not responsible for injuries or accidents during the session.

SCHEDULING
Weather conditions such as cloudy, chilly or overcast do not qualify for a rescheduled session (exceptions made during severe weather conditions, heavy rain, and winter months). If a client wishes to reschedule, Julbaby Photography LLC will provide one opportunity (indoor or outdoor) to reschedule, and is not obligated to guarantee additional dates and times. If the session is canceled twice, the photographer reserves the right to refuse future appointments. If a client wishes to reschedule during the photo session, they must do so within the first ten minutes of the photographer’s arrival or prior to the session. Photographer reserves the right to change an outdoor location based on changes in the park’s schedule, events, last minute or unexpected interferences (excluding events). Julbaby Photography LLC reserves the right to reschedule and/or cancel. Payment will be 100% refunded only if the photographer must cancel and cannot reschedule.

GALLERY
Only the best photos from the session will be edited and released. Photographer does not release unedited or RAW images. As per custom photography, photographer individually selects the best photos based on photographic elements as well as the style that best represents the brand. Clients will receive five (5) retouched digital files with edits as necessary. Client has printing rights to these digital photos, and must only share digital photos with the company logo on the web. Within three weeks of a session, client will receive a digital link to access their gallery and Julbaby Photography LLC's online store including the best edited photos from session. Client is responsible for downloading the images and saving them to flash drive, hard drive, desktop or digital cloud as files are deleted after 14 days. Client may purchase prints and products from Julbaby Photography LLC's online store. Client may be responsible for taxes and shipping depending on their order. Delivery dates for photo products from the online store will vary.

QUALITY CHECK
Quality concerns with Julbaby Photography LLC’s photos and products must be addressed within 48 hours of receipt in one e-mail exchange from both parties or one 10-20 minute phone conversation. All photos and products are final sale, and complimentary sessions are one-time only. Photographer’s fee for additional adjustments after gallery delivery is $35/hour including complimentary sessions, and must be requested within 48 hours of the gallery delivery. Editing adjustments after gallery delivery are not guaranteed, and the decision to make adjustments is based on the photographer’s judgment and availability. Photographer has the right to refuse requests to make additional edits, adjustments and future sessions.

ADVERTISING & SHARING
Julbaby Photography LLC reserves the right to use photos for advertisement. Printed photos may not be reproduced and sold by another printing vendor or individual. Printed and digital photos without watermarks may not be shared on the web. Watermarks may not be cropped out of photos shared on the web.

SESSION RECOMMENDATIONS & ACKNOWLEDGEMENT OF CUSTOM PHOTOGRAPHY
Finally, by processing your payment, you agree that you have carefully read this agreement as well as read the “recommendations” tab on the business website www.julbabyphotography.com for preparation details. Any questions or concerns noted in this contract must be discussed prior to processing the payment and signing this agreement.

1) By processing your payment, you agree to the terms of this digital agreement
2) You must take a screen shot of this agreement for your records. Copies will not be provided.
3) You must e-mail [email protected] with your first and last name in the subject line, and home mailing address, and contact number in the body of the e-mail and formally book your appointment by by 12/31/18.
